Health Data |
| 1. The App requires access to health data stored on your mobile device. By using the App, you grant the App permission to read this data. You acknowledge and accept the fact that the App must store and process this information in order to reward you for your activity and consent to its use by the App in accordance with our Privacy Policy. |
User Generated Content |
| 1. Users may upload images, stories, and other content ("User Content") to the App. Users may also modify other information relating to leagues, teams and players as permitted by the App. |
| 2. You are solely responsible for ensuring that you own the rights to any User Content you upload, or that the content is in the public domain. |
| 3. You grant the Company a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any User Content that you post on or in connection with the App. |
| 4. The Company can cancel your account at any time for any reason, particularly for violation of these Terms. |
Prohibited Content |
| 1. You agree not to input or upload content that is slanderous, offensive, illegal, pornographic or in violation of anyone's rights. All content input or uploaded by you must be considered 'Family Friendly' by the most conservative of standards. |
| 2. The Company is not responsible for reviewing User Content for legality, appropriateness, or compliance with these Terms. |
Disclaimers and Limitation of Liability |
| 1. The Company does not endorse User Content and expressly disclaims any liability in connection with User Content. |
| 2. You agree to indemnify and hold harmless the Company and its directors, officers, employees, and agents from and against any claims arising from or relating to User Content that you upload, or that has been uploaded by other users. |
Changes to Terms |
| 1. The Company reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Company's website at https://boostsports.fitness/terms.html. Your continued use of the App after any such change constitutes your acceptance of the new Terms. |
Governing Law |
| 1. These Terms shall be governed by and construed in accordance with the laws of the state where Boost Fitness, LLC is registered, without regard to its conflict of law provisions. |
